Terms of Service

These Terms apply when you use Firequote — our mobile app, web pages, and all related services. By creating an account or using Firequote in any way, you agree to these Terms. If you don't agree, don't use Firequote.
We've kept these Terms as direct as we can. If something is unclear, email us at legal@firequote.app.
Who we are
Firequote is a Dutch eenmanszaak (sole proprietorship) registered in the Netherlands.

In these Terms, "we", "us" and "our" mean Firequote. "You" and "your" mean the person or business using Firequote.
About payments: Pro subscriptions are sold by Apple through the App Store on iOS and by Google through Google Play on Android. Apple and Google act as the Merchant of Record for those purchases — they process the payment, collect any applicable VAT or sales tax, issue the receipt, and handle refunds and chargebacks. Product support for Firequote itself comes from us.
Who can use Firequote
To use Firequote you must:
- Be at least 18 years old (or the age of legal majority in your country, if higher) — this is a contract law requirement, separate from our Privacy Policy's minimum age of 16 for data processing
- Have the legal capacity to enter into a contract
- Be using Firequote for business purposes (Firequote is a tool for freelancers and small businesses, not a consumer product)
- Provide accurate information when you sign up and keep it up to date
- Not be barred from using Firequote under the laws of your country, the Netherlands, or any country where we offer the service
Account security and your responsibility
You are responsible for everything that happens under your account, including activity by anyone you give access to (intentionally or not). Specifically:
- Keep your login credentials confidential. Don't share your password.
- Use a strong, unique password.
- Tell us immediately if you suspect someone else has accessed your account.
- We are not liable for losses caused by unauthorized access to your account if you didn't take reasonable steps to protect it.
If we believe an account is compromised, we may suspend it temporarily and contact you to verify before restoring access.
Free and Pro plans
Firequote has two plans:
Free — up to 3 AI-generated proposals per month, no e-signatures, no custom branding removal (documents include a "Created with Firequote" footer), no Smart Signals, and basic analytics only (all-time summary totals — no period filtering, no detailed charts). You can still create unlimited manual proposals and invoices, connect Stripe, and use all core features.
Pro — full access to all features for a monthly or yearly subscription fee. Prices are set per-territory in App Store Connect and Google Play Console and shown to you in your local currency at the point of purchase. Current pricing is also shown on our pricing page.
We may change Free plan limits over time. If we reduce what you can do on the Free plan, we'll tell existing users in advance and give you a fair chance to upgrade or export your data. We may also add new features to either plan without notice.
What happens if you downgrade from Pro to Free
If you cancel Pro and drop back to Free, or if your Pro subscription ends:
- Your existing proposals and invoices stay in your account and remain readable.
- If you're over the Free plan limits, you won't be able to create new proposals or invoices until you're back under the limit (by deleting old drafts) or you upgrade again.
- Pro-only features (e-signature, custom branding, etc.) become unavailable on new documents.
- Documents you already created with Pro features remain unchanged.
Subscriptions, billing, and cancellation
Subscription details
Firequote Pro is offered as a monthly or annual auto-renewable subscription. When you subscribe through the app:
- Payment is charged to your Apple ID account (iOS) or Google Play account (Android) at confirmation of purchase.
- Your subscription automatically renews at the end of each billing period at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours prior to the end of the current period at the price for the chosen package.
- You can manage and cancel your subscription, and turn off auto-renewal, in your Apple ID Account Settings (iOS) or your Google Play → Subscriptions screen (Android). You cannot cancel a subscription from inside the Firequote app — Apple and Google control the cancellation flow.
Prices are set per-territory and shown to you in your local currency in the App Store or Play Store at the time of purchase.
Who you are buying from
When you subscribe to Pro, the seller of the subscription is Apple or Google, not Firequote. Apple and Google act as the Merchant of Record. They handle:
- The payment transaction (the cards, wallets, and payment methods linked to your store account)
- Calculating and collecting any applicable VAT or sales tax for your country
- Issuing receipts
- Refunds and chargebacks
- Customer service for billing-related questions
We never see your card details or payment information. We only receive your subscription status (active, cancelled, in grace period, etc.) from Apple and Google through our subscription middleware so we can grant you Pro access.
By subscribing, you accept the Apple Media Services Terms (App Store) or Google Play Terms of Service in addition to these Terms.
Payment processing — clarification of roles
Firequote is software. Pro subscription payments are processed by Apple Inc. (App Store on iOS) or Google LLC / Google Ireland Ltd. (Google Play on Android), depending on the platform you subscribe from. These are the licensed payment providers and merchants of record for those transactions.
Firequote does not process, route, or custody payments between you and Apple or Google.
Separately, where you (the freelancer) connect your own Stripe account to receive payment from your clients on invoices, those client-payment transactions are handled exclusively by Stripe Payments Europe Ltd. ("Stripe") through your own Stripe Connect account, under Stripe's terms of service. Firequote has no access to those funds and assumes no payment processing role for client-to-freelancer payments either.
Cancelling
To cancel your Pro subscription:
- iOS: open Settings → [your name] → Subscriptions and select Firequote. Or open the App Store, tap your profile, and tap Subscriptions.
- Android: open the Google Play Store, tap your profile, then Payments & subscriptions → Subscriptions, and select Firequote.
You can also visit reportaproblem.apple.com (iOS) or play.google.com/store/account/subscriptions (Android).
When you cancel, you keep Pro access until the end of the current billing period. After that you drop back to Free automatically.
Refunds
We are not the seller and we cannot issue refunds ourselves. Refund requests for Pro subscriptions must go to Apple or Google:
- iOS: reportaproblem.apple.com — Apple decides each refund request on its own policy.
- Android: support.google.com/googleplay → Refunds — Google decides on its own policy.
Goodwill advocacy. If you have a genuine issue with Firequote in your first 30 days and Apple or Google declines your refund, email support@firequote.app and we will advocate on your behalf where we can. The final decision is still Apple's or Google's.
EU consumers. If you are an EU consumer, your statutory 14-day right of withdrawal under EU law applies — exercise it through the App Store or Play Store within 14 days of subscribing.
Failed payments
If your payment fails:
- Apple or Google will retry the charge on their own schedule and notify you to update the payment method linked to your store account.
- During the grace period set by Apple or Google, your Pro access continues; after that, the account drops back to Free until payment is sorted.
- Your Firequote data remains intact during this period.
Chargebacks
If you raise a chargeback with your card provider for a charge you actually authorized and used, Apple or Google may close your subscription, and we may suspend or refuse future Pro access. If you have a problem with a charge, please contact Apple or Google first using the links above — we'd much rather see it sorted than fight a chargeback.
Price changes
If we change the subscription price:
- Apple and Google will notify existing subscribers ahead of the change and request your consent to continue at the new price where required by their policies and applicable law.
- You can cancel before the new price takes effect through your Apple ID or Google Play subscription settings.
- Existing subscribers typically keep their current price for the remainder of the current billing cycle.
What you can do with Firequote, and what you cannot
You can use Firequote for any lawful business purpose. The only things you cannot do:
- Use Firequote for anything illegal — fraud, scams, illegal services, sanctioned activities
- Send proposals or invoices for goods or services that are illegal in your country or your client's country
- Use Firequote to send spam — every recipient must be a real client expecting to hear from you
- Try to reverse-engineer, copy, or scrape Firequote
- Try to break into Firequote, bypass rate limits, or interfere with how the service works for other users
- Use automated tools to create accounts or generate content at scale
- Resell or sublicense Firequote to others without our written permission
- Create accounts using fake names or someone else's identity
- Upload viruses, malware, or anything intended to harm our systems or our users
- Use Firequote in any way that violates someone else's rights — copyright, trademark, privacy, or anything else
- Use Firequote to sell anything prohibited by the App Store Review Guidelines or Google Play Developer Policy
If you break these rules, we may suspend or terminate your account immediately. See the Termination section below.
Your content
Anything you create or upload to Firequote — your proposals, invoices, raw notes, logo, brand colour, contact lists, signed documents — is your content. You own it. We don't claim any rights over it beyond what we need to actually run the service.
By using Firequote, you grant us a limited licence to:
- Store your content on our infrastructure
- Process it to provide the service (generate proposals from your notes, render PDFs, deliver emails to your clients, etc.)
- Send relevant parts to our processors as listed in our Privacy Policy
- Display your logo and branding on documents you create
This licence ends when you delete the content or your account, except for data we're required to keep (see our Privacy Policy for retention details).
You confirm that:
- You have the right to upload everything you upload (your logo, your client information, anything else)
- Your content does not violate anyone's rights
- You have permission to enter your clients' contact information into Firequote and send them proposals through it
AI-generated content
Firequote uses AI (Anthropic's Claude API) to help generate proposal text from notes you provide. A few things you should understand:
The output is not legal or financial advice. It's a draft. You are the expert on your own business. Always read what the AI produced before sending anything to a client.
You are responsible for what you send. Once you send a proposal or invoice, the content is yours. We are not responsible for AI-generated text that turns out to be inaccurate, misleading, or unsuitable for your situation.
The AI may make mistakes. It might invent details, get pricing wrong, miss important caveats, or use phrasing that doesn't fit your business. That's why every output is editable — we expect you to review and adjust.
You own the proposal text after generation. Whatever you send to a client is yours. We don't claim copyright over AI-generated proposals you create with Firequote.
Proposal acceptance and e-signatures
When you send a proposal through Firequote, your client can accept it by clicking an accept button or, on Pro, by typing or drawing a signature. We record the timestamp, IP address, browser/device information, and the name typed during signing.
What this is: evidence that your client interacted with the proposal and accepted it. We store this audit trail and embed the signature into the resulting PDF.
What this is not: a qualified electronic signature under eIDAS or any other regulatory framework. We are not a qualified trust service provider. We do not guarantee that an acceptance recorded through Firequote will be legally binding in your jurisdiction or in court.
Your responsibility: you are responsible for making sure your contracts and acceptance methods meet the legal requirements for your industry and country. If your contracts require notarisation, qualified signatures, or specific formalities, use a qualified e-signature service like DocuSign, Adobe Sign, or a licensed notary. Firequote is not a substitute for those.
We provide the tool and the audit trail. Whether the agreement is enforceable is between you and your client.
Your relationship with your clients
Firequote is the tool you use to send proposals and invoices. We are not a party to any contract between you and your client. Specifically:
- We don't guarantee that your clients will pay
- We don't guarantee that your proposals will be accepted
- We don't mediate disputes between you and your clients
- We're not responsible if a client claims they didn't see, didn't agree to, or didn't understand a proposal you sent through Firequote
- We don't review the contents of what you send — that's between you and your client
If a client contacts us about something you sent them, we will tell them to contact you directly. We may help with privacy-related requests as required by law (see our Privacy Policy).
Data Processing Agreement (GDPR Article 28)
When you enter your clients' personal data into Firequote (their name, email, company), you are acting as the data controller for that data, and we act as your data processor. This means we process your clients' data only on your instructions and in line with our Privacy Policy.
By accepting these Terms, you and we both agree that the data processing terms in our Privacy Policy form a Data Processing Agreement under GDPR Article 28, covering:
- The subject matter and duration of processing (the period of your account)
- The nature and purpose of processing (running Firequote on your behalf)
- The types of personal data and categories of data subjects (your clients' contact data)
- Our obligations to process data only on your instructions, keep it confidential, use approved subprocessors, help you respond to data subject requests, notify you of breaches, and delete or return data when our service ends
If you need a separate signed DPA document for your records or your own clients' compliance, email us and we'll provide one.
Service availability
We try hard to keep Firequote running, but we don't guarantee 100% uptime. The service is provided as-is and as available.
We may need to:
- Take the service offline for maintenance (we'll try to schedule this outside business hours)
- Make changes that temporarily affect features
- Disable specific features for security reasons
We don't currently offer a Service Level Agreement (SLA) or uptime guarantee. If we ever do, it'll be a separate document.
If something goes wrong on our end and Firequote is down for an extended period, contact us and we'll work it out. We won't normally issue refunds for short outages.
Account suspension and termination
When we may suspend or terminate your account
We may suspend or terminate your account, with or without notice, if:
- You break these Terms
- We have reason to believe you're committing fraud, abuse, or anything illegal
- Your payments fail repeatedly and aren't sorted within a reasonable time
- You raise an unjustified chargeback
- We're legally required to (court order, sanctions, etc.)
- We decide to discontinue Firequote entirely (we'll give at least 60 days' notice for this)
For minor or first-time issues, we'll usually warn you first and give you a chance to fix it. For serious issues — fraud, illegal activity, security threats — we may act immediately.
When you may terminate
You can stop using Firequote any time by:
- Cancelling your subscription (see Subscriptions section)
- Deleting your account from inside the app
Cancellation stops billing. Account deletion removes your data per the rules in our Privacy Policy.
What happens on termination
When your account ends (whether you delete it or we terminate it):
- Your access to Firequote stops
- Your data is deleted per the schedule in our Privacy Policy
- Any unpaid amounts you owe us remain due
If we terminate your account for cause (you broke the rules), we won't refund any prepaid fees.
If we terminate your account without cause (for example, we're shutting down Firequote), we'll advocate with Apple or Google to refund a fair pro-rated portion of any prepaid yearly fees. The decision is theirs as Merchant of Record.
Our intellectual property
Firequote — the app, the website, the brand, the logo, the design, the code, our marketing materials — is owned by us. These Terms don't transfer any of that to you. You can use Firequote as a customer, and that's it.
You may not:
- Copy, modify, or distribute our app or website
- Remove or alter any branding, copyright notices, or trademarks
- Use our name or logo in your own marketing without written permission
- Build a competing product based on our service
If you provide us feedback, suggestions, or ideas about Firequote, we can use them freely without owing you anything. We won't claim you suggested something publicly without asking, but we don't owe you compensation or credit for ideas you share with us.
Disclaimers
Firequote is provided "as-is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law. Specifically, we do not warrant that:
- The service will be uninterrupted, error-free, or available at any specific time
- AI-generated content will be accurate, complete, or fit for your purpose
- Proposals or invoices created in Firequote will be legally enforceable
- Your clients will accept proposals or pay invoices
- Any specific feature will continue to be available
You use Firequote at your own risk and discretion.
This section does not exclude any warranties or rights that cannot legally be excluded under the law that applies to you (for example, mandatory consumer protections under EU law, if they apply).
Limitation of liability
To the maximum extent permitted by law:
We are not liable for indirect or consequential damages, including lost profits, lost business, lost data, lost goodwill, lost contracts, or any damage that's not a direct and foreseeable result of something we did wrong.
Our total liability to you, for any reason, is capped at the greater of:
- The total amount you paid us in the 12 months before the event giving rise to the claim, or
- €100 (one hundred euros)
This cap applies whether the claim is based on contract, negligence, statute, or anything else.
Time limit for claims: any claim you bring against us must be filed within 12 months of the event giving rise to the claim. After that, the claim is permanently barred. This does not apply where mandatory law in your country sets a longer non-waivable period.
This section does not limit liability that cannot be limited by law — for example, liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any non-waivable rights you have under EU consumer law (if applicable).
Indemnification
If someone sues us, threatens to sue us, or makes a complaint to a regulator because of:
- Something you did using Firequote
- Content you uploaded or sent
- A contract you made with a client through Firequote
- Your violation of these Terms or any law
— then you agree to defend us, cover our reasonable legal costs, and pay any damages or settlements that result. We'll let you know about the claim promptly and reasonably cooperate with you on the defence.
Changes to these Terms
We may update these Terms from time to time. When we do:
- We'll update the "Last updated" date at the top
- For significant changes, we'll notify active users by email and/or in the app at least 30 days before the change takes effect
- For minor changes (typo fixes, clarifications), we may update without notice
If you keep using Firequote after changes take effect, you've accepted the new Terms. If you don't agree, stop using Firequote and cancel your subscription before the change date.
General terms
Standard legal provisions that apply to these Terms:
Force majeure
Neither you nor we are responsible for failing to perform obligations under these Terms when prevented by events outside our reasonable control, including: natural disasters, fires, floods, pandemics, war, terrorism, civil unrest, strikes, internet outages, cyberattacks, hosting and payment provider downtime (including Supabase, Vercel, Anthropic, Apple App Store, Google Play, and RevenueCat), denial-of-service attacks, government actions, sanctions, or changes in law that prevent the service from operating.
If a force majeure event happens, the affected party will notify the other within a reasonable time, take reasonable steps to reduce the impact, and resume normal performance as soon as possible. If the event continues for more than 60 consecutive days, either of us may terminate the agreement without liability.
Lack of funds is not a force majeure event.
Severability
If any part of these Terms is found to be invalid or unenforceable by a court, the rest of these Terms still apply. The invalid part will be replaced with a valid provision that comes as close as possible to the original intent.
Entire agreement
These Terms, together with our Privacy Policy, are the entire agreement between you and us about your use of Firequote. They replace any prior agreements, promises, or representations on the same subject. Anything not written in these documents (or another signed agreement between us) doesn't apply. Your separate agreement with Apple (Apple Media Services Terms) or Google (Google Play Terms of Service) governs the payment relationship between you and the relevant store.
Assignment
You may not transfer or assign these Terms or your account to anyone else without our written consent. We may transfer these Terms freely — for example, to a buyer if Firequote is acquired, or to a successor entity if Firequote reorganises. We'll notify you if this happens.
Waiver
If we don't enforce a provision of these Terms once, that doesn't mean we've given up the right to enforce it later. Any waiver must be in writing to be effective.
Survival
The following sections continue to apply even after your account ends or these Terms are terminated: Your content (the licence ends but ownership and confirmations stay), AI-generated content, Proposal acceptance and e-signatures, Your relationship with your clients (including the DPA terms), Our intellectual property, Disclaimers, Limitation of liability, Indemnification, Governing law, and these General terms.
Notices
We send legal notices to the email address registered on your account. Notices are effective when sent. Make sure your email address stays current — if a notice bounces because your email is wrong, the notice is still considered delivered.
You send legal notices to us at legal@firequote.app or by post to our registered address listed at the top of these Terms.
No third-party beneficiaries
These Terms are between you and us. No one else has any rights under these Terms — except Apple Inc., which is an intended third-party beneficiary of the Apple App Store terms section below and may enforce those provisions against you.
Headings
Section headings are for convenience only. They don't affect how the Terms are interpreted.
Language
These Terms are written in English. If we provide a translation, the English version controls if there's any conflict.
Governing law and disputes
These Terms are governed by the laws of the Netherlands.
If we have a dispute, let's try to resolve it directly first. Email us and we'll do our best to sort it out.
If we can't sort it out, the dispute will be heard by the competent court in Amsterdam, the Netherlands, unless mandatory law in your country requires otherwise.
This does not take away any non-waivable consumer rights you may have under your local law (if those apply to you).
Apple App Store terms
If you downloaded Firequote from the Apple App Store, the following extra terms apply (Apple requires us to include these):
- These Terms are between you and us, not between you and Apple. We are responsible for Firequote, not Apple.
- Apple has no obligation to provide support for Firequote. Contact us instead.
- If Firequote fails to conform to any applicable warranty that cannot be disclaimed, you may notify Apple and Apple will refund the App Store purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation related to Firequote.
- If a third party claims Firequote infringes their intellectual property, we (not Apple) are responsible for handling it.
- You confirm you're not located in a country subject to a US embargo or designated as supporting terrorism, and you're not on any US restricted-party list.
- Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.
Pro subscriptions purchased on iOS are billed by Apple through the App Store's In-App Purchase system. Your purchase is also governed by your Apple Media Services Terms in addition to these Terms. See the Subscriptions, billing, and cancellation section above for the auto-renewal, cancellation, and refund details.
Google Play terms
If you downloaded Firequote from Google Play, your use of the app is also subject to Google Play's Terms of Service for app distribution. Where there's any conflict between Google Play's terms and these Terms about how the app was distributed, Google Play's terms apply for that specific point.
Pro subscriptions purchased on Android are billed by Google through Google Play Billing. See the Subscriptions, billing, and cancellation section above for the auto-renewal, cancellation, and refund details.
